Terms and Conditions

Welcome to Luma ("Service"), a health and nutrition tracking application provided by Nakshatra AI Technologies ("Company", "we", "us", or "our"). By creating an account or using the Service, you ("User", "you") agree to be bound by these Terms and Conditions ("Terms").

1. Service Description

Luma is a personal health tracking tool that allows users to log calories, macronutrients, exercise, weight, and optionally lab values. The Service may provide suggestions, insights, and recommendations based on user-entered data.

2. Beta Status and "As Is" Disclaimer

Luma is currently in private beta. The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of data
• Warranties of uninterrupted or error-free operation
• Warranties regarding security or data protection

You acknowledge that beta software may contain bugs, errors, and other issues that could cause system failures, data loss, or other problems.

3. No Medical Advice

Luma is NOT a medical device and does not provide medical advice. The Service is intended for informational and educational purposes only. Always consult with qualified healthcare professionals before making any health-related decisions. We are not responsible for any health outcomes resulting from use of the Service.

4. AI-Generated Content Disclaimer

Luma uses artificial intelligence services, including but not limited to OpenAI and Google, to provide suggestions, analyze food items, estimate nutritional values, and generate recommendations. You acknowledge and agree that:

• AI-generated suggestions may be incorrect, inaccurate, or inappropriate
• Nutritional estimates and glycemic index values may contain errors
• You are responsible for verifying any information before relying on it
• We are not liable for any decisions made based on AI-generated content
• You may correct any values at any time through the portal

5. Data Security and Privacy

While we implement reasonable security measures, we cannot guarantee the security of your data. You acknowledge that:

• Data breaches and leaks may occur
• Your data may be accessed by unauthorized parties
• We are not liable for any damages resulting from data security incidents
• You should not enter sensitive information you cannot afford to have exposed

6. Data Use, Telemetry, and Advertising (CCPA/GDPR)

By using Luma, you consent to the collection and use of your data for:

• Providing and improving the Service
• Analytics and telemetry to understand usage patterns
• Research and development purposes
• Potential advertising and marketing purposes
• Sharing with third-party AI providers (OpenAI, Google) for feature functionality

Your Rights (CCPA/GDPR):

• You have the right to know what data we collect
• You have the right to request deletion of your data
• You have the right to opt out of data collection for advertising
• To exercise these rights, including opting out, you may delete your account at any time through the Settings page in the application

7. User Responsibilities

You agree to:

• Provide accurate information when creating your account
• Keep your login credentials secure and confidential
• Not use the Service for any unlawful purpose
• Not attempt to circumvent security measures
• Accept full responsibility for all data you enter into the Service

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAKSHATRA AI TECHNOLOGIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from unauthorized access to your data
• Any damages resulting from reliance on AI-generated content
• Any health outcomes or medical decisions made using the Service

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

9. Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in California, USA. The arbitrator's decision shall be final and binding. You agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nakshatra AI Technologies and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Nakshatra AI Technologies regarding the Service and supersede all prior agreements and understandings.
